DMCA POLICY

At Wildsvg, we hold in high regard the intellectual property rights of all individuals, mirroring the expectation for others to reciprocate this respect towards our rights. In adherence to the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their duly authorized agents possess the prerogative to lodge a takedown notice with us via our designated DMCA Agent. As an internet service provider, we retain the privilege to assert immunity against purported infringement claims under the protective purview of the DMCA’s “safe harbor” provisions.

To instigate a bona fide infringement claim, the submitting party must furnish us with a notice encompassing the following requisite details:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner or an individual duly authorized to act on their behalf.
  2. Identification of the copyrighted work alleged to have been infringed.
  3. Clear delineation of the infringing material necessitating removal, accompanied by information reasonably facilitating our ability to pinpoint said material. (Kindly furnish the URL of the pertinent page to aid in identifying the allegedly offending content.)
  4. Information adequately enabling us to contact the aggrieved party, including their name, physical address, email address, phone number, and fax number.
  5. A statement affirming the complainant’s bona fide belief in the unauthorized utilization of the material by the alleged infringer.
  6. A declaration asserting the accuracy of the information provided in the notification, coupled with an attestation, under penalty of perjury, to the complainant’s authorization to act on behalf of the copyright owner.

It is imperative to note that Title 17 USC §512(f) delineates civil damage penalties, encompassing costs and attorney fees, against any individual who knowingly and materially misrepresents pertinent information in a notification of infringement under 17 USC §512(c)(3).

Kindly be apprised that we retain the prerogative to divulge the identity and information contained within any copyright infringement claim received with the implicated infringer. By submitting a claim, you acknowledge, accept, and consent to the potential communication of your identity and claim to the alleged infringer.

Counter Notification – Restoration of Material

In the event of receipt of a notice mandating material takedown owing to a copyright infringement claim, the affected party reserves the right to furnish us with a counter-notification, seeking the restoration of the impugned material to the site. Said notification must be rendered in writing to our designated DMCA Agent and should substantially incorporate the following elements pursuant to 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A comprehensive description of the material subjected to takedown and its original location before removal.
  3. A solemn statement, under penalty of perjury, affirming your bona fide belief in the mistaken or erroneous removal or disablement of the material.
  4. Your name, address, and telephone number, accompanied by a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if located outside the United States, consenting to the jurisdiction of any judicial district wherein the service provider may be found), and a declaration agreeing to accept service of process from the individual or entity who furnished the original infringement notification.

Repeat Infringer Policy

At Wildsvg, we adopt a stringent stance towards copyright infringement. In conformity with the requisite stipulations of the Digital Millennium Copyright Act, we meticulously maintain a catalog of DMCA notices from copyright holders, diligently endeavoring to identify any recurrent infringers. Any individual found in contravention of our internal repeat infringer policy will face the termination of their accounts.

Modifications

We explicitly reserve the prerogative to effect modifications to the contents of this page and its accompanying policy governing the handling of DMCA claims at our sole discretion and prerogative.
